An Affiliate Program: Allowing partners to earn commissions for referrals.

Important Disclaimer: Pet Pro Search is a platform, not a service provider. We do not provide pet care, veterinary, or professional business services directly. Any agreement made between a user and a professional or vendor found on this site is strictly between those two parties.

1.2. Eligibility

By using this site, you represent and warrant that:

You are at least 18 years of age.
You have the legal capacity to enter into a binding contract.
If you are registering on behalf of a business, you have the authority to bind that entity to these Terms.

1.3. Modifications to Terms

We reserve the right to change or modify these Terms at any time. We will notify users of significant changes by posting a notice on our homepage or via email. Your continued use of the site after such changes constitutes your acceptance of the new Terms.

Key Definitions:

“Pro” / “Business”: Any individual or entity listing their services in our directory.
“Pet Owner”: Any individual browsing the site to find services for their animals.
“Vendor”: A business-to-business provider offering products or services to other pet professionals.
“Affiliate”: A registered user participating in our referral program.
”Collaborator”: A podcaster, social media personality, or influencer who participates in our collaboration program.

2. User Roles and Responsibilities

All users agree to provide accurate information and to use Pet Pro Search only for its intended purposes.

2.1. General Responsibilities (All Users)

Regardless of your account type, you agree to:

Accuracy: Maintain truthful and up-to-date profile information.
Security: Keep your account credentials confidential. You are responsible for all activity occurring under your account.
Lawful Use: Not use the site for any illegal purposes or to transmit “spam,” malware, or defamatory content.

2.2. Pet Owners (Service Seekers)

Due Diligence: You acknowledge that Pet Pro Search does not perform background checks, site visits, or medical evaluations of the professionals listed. It is your sole responsibility to interview, verify licenses, and check references of any professional before hiring.
Reviews: If you leave a review, it must be based on a genuine experience and remain free of profanity or personal attacks.

2.3. Pet Professionals and Vendors (Service Providers)

Verification of Credentials: You represent that you possess all necessary licenses, permits, insurance, and certifications required by your local jurisdiction to operate your business.
Listing Quality: You must not misrepresent your services, pricing, or location. Vendors must clearly distinguish between consumer-facing services and B2B products.
Responsiveness: While not strictly enforced by us, you agree to handle inquiries from pet owners or other businesses in a professional and timely manner.

2.4. Affiliates (Referral Partners)

Ethical Promotion: You must represent Pet Pro Search accurately. You may not use “scum-ware,” pop-unders, or hidden links to force affiliate cookies.
No Brand Impersonation: You may not create social media accounts or websites that lead users to believe you are Pet Pro Search corporate.

3. Prohibited Conduct

To maintain the quality of our directory, the following actions are strictly prohibited:

Scraping: Using automated scripts or “bots” to harvest contact information from our directory.
Fee Circumvention: Attempting to bypass our listing fees through fraudulent account creation.
Harassment: Using the platform’s messaging or contact features to harass, threaten, or stalk other users.
False Endorsements: Creating fake accounts to provide positive reviews for your own business or negative reviews for a competitor.

4. Affiliate Program Terms & Conditions

By participating in the Pet Pro Search Affiliate Program, you agree to abide by the following rules. Failure to comply may result in immediate termination of your affiliate account and forfeiture of any pending commissions.

4.1. Qualification for Commission

Qualified Referrals: A commission is earned only when a new customer clicks your unique affiliate link and completes a purchase of a Paid Listing package.
Cookie Duration: We operate on a 5 day cookie window. If a user clears their cookies or uses a different browser before purchasing, the sale may not be tracked.
Validation Period: Commissions are “pending” for a period of 30 days to account for potential credit card chargebacks or cancellations.

4.2. Affiliate Commissions & Performance Bonuses

Direct Sales: 10% commission on new sales.
Recurring Revenue: 5% commission on future subscription payments by your referrals.
Build Your Pack: Earn 3% on sales by Level 2 recruits and 1% on Level 3.
Monthly Milestone Bonuses: Earn $50 at $2,500 in sales and $75 at $5,000 in sales.
Performance Reward: The top affiliate with a listing each month receives a 30-day Featured Listing (or a 10-day extension for Elite members).

4.3. Payout Terms

Minimum Threshold: Affiliates must reach a minimum balance of $50 before a payout is triggered.
Payment Method: Payouts are issued via Paypal on the 15th of each month.
Tax Documentation: You are responsible for any taxes owed on your earnings. We may require a Form W-9 or equivalent before processing large payments.

4.4. Prohibited Marketing Practices

To protect the integrity of the Pet Pro Search brand, the following actions are strictly prohibited:

Self-Referrals: You may not use your own affiliate link to purchase a listing for your own business.
Keyword Bidding (PPC): You may not bid on “Pet Pro Search” or any variations/misspellings of our trademarked name on Google Ads, Bing Ads, or other search engines.
Spamming: Use of “cold” unsolicited emails, mass social media tagging, or automated “bot” comments to spread your link is prohibited.
Deceptive Claims: You must not make false promises regarding the results a business will get from our directory.

4.5. Content Standards & Brand Integrity

Pet Pro Search maintains a high standard for brand alignment. Your affiliate account may be terminated immediately if your marketing efforts or primary platforms include:

Non-Family Friendly Content: Use of profanity, sexually explicit material, violence, or any content deemed inappropriate for a general audience.
Animal Mistreatment: Any content depicting, promoting, or normalizing the neglect, abuse, or unethical treatment of animals.
Offensive Material: Content that promotes discrimination based on race, gender, religion, nationality, disability, or age.

4.6. FTC Disclosure Requirements

In compliance with FTC guidelines, all affiliates must clearly and conspicuously disclose that they receive a commission for referrals.

Example Disclosure: “As an affiliate, I earn a commission if you purchase a listing through my link.”
This disclosure must be placed near the affiliate link and should not be hidden in fine print.

4.7. Relationship of Parties

Participation in this program does not create an employment, partnership, or joint venture relationship. You are an independent contractor and have no authority to bind Pet Pro Search to any contracts.

5. Collaborator Program Terms & Conditions

By participating in the Pet Pro Search Collaborator Program, you agree to adhere to the following guidelines. Failure to maintain compliance may result in the immediate termination of your collaborator status, a mandatory reversion to the standard Free Tier, or removal of your listing at the sole discretion of Pet Pro Search.

5.1. Eligibility Requirements

Participation is contingent upon meeting audience thresholds on a single, verified primary platform.

Professional Tier: 2,500+ followers/members. ($16.99/mo value)
Premium Tier: 25,000+ followers/members. ($39.99/mo value)
Elite Tier: 250,000+ followers/members. ($99.99/mo value)

5.2. The Tier Exchange & Store Credit Program

Qualified collaborators receive upgraded Tier access and supplemental Store Credit in exchange for promotional consideration.

The “First Look” Bonus: Your first verified organic mention of PetProSearch.com instantly earns you enough Store Credit to upgrade your listing to the Tier matching your eligibility for one full month.
Continuous Store Credit Accrual: Beyond the increased visibility of an upgraded listing, collaborators earn additional Store Credit based on the monthly value of their eligible Tier:
- Subsequent Mentions: Each additional unique, verified mention accrues Store Credit at a rate of 33% of your eligible Tier’s monthly value.
Annual Accumulation Cap: Store Credit accumulation is limited to a maximum value equivalent to twelve (12) monthly subscription payments of your eligible Tier per calendar year.
Credit Expiration: All earned Store Credit expires one (1) year (365 days) from the date it is credited to your account.
No Cash Value: Store Credit is non-transferable, has no cash value, and cannot be exchanged for currency. It is provided solely as a performance bonus to enhance your brand’s presence and reach on the platform.

5.3. Content Standards & Brand Protection

Animal Welfare: Zero-tolerance policy for mistreatment of animals, as determined at the sole discretion of Pet Pro Search.
Brand Integrity: We reserve the right to terminate listings for disparaging or defamatory content.
Private Group Access: Verification (screenshots or temporary access) is required for promotions in closed communities upon request.

5.4. Expiration, Payment, & Listing Status

Credit Expiration: Upon the exhaustion of all earned Tier credits, the listing status will automatically transition to a Paid Listing at the current Tier rate.
Required Action: To maintain an active premium listing, the collaborator must complete one of the following:
1. Provide valid payment information to continue the subscription.
2. Submit a new verified Mention (or mentions) to accrue additional store credit and Tier time.
3. Manually downgrade to a Free/Basic Listing to avoid future billing.
Automatic Removal: If no action is taken (payment, new mention, or manual downgrade) within 14 days of credit expiration, the listing may be automatically removed from the platform for non-payment.
Recreation Required: Once a listing is removed for non-payment, the data cannot be recovered. To reappear in the directory, a new listing must be created and submitted for approval.

5.5. Termination & Program Modification

Violation of Terms: Pet Pro Search reserves the right to immediately terminate any collaboration for a violation of these Terms or the site Terms of Service. In such cases, the account will revert to a Free/Basic Listing, and all accrued Store Credit will be forfeited.
Program Capacity: Pet Pro Search reserves the right to limit the total number of active collaborators to ensure program sustainability.
Right to Modify: Pet Pro Search reserves the right to modify, suspend, or terminate the program or adjust Tier exchange values with 30 days’ notice.

6. Paid Listings and Subscription Terms

Pet Pro Search offers both free and premium (paid) directory listings. By upgrading to a paid listing, you agree to the following financial terms:

6.1. Fees and Billing

Subscription Tiers: Fees for paid listings are clearly stated on our “Pricing” page. We reserve the right to modify these fees at any time; however, fee changes will only apply to your next billing cycle.
Payment Processing: All payments are processed through secure third-party providers (e.g., Stripe, PayPal). By providing your payment information, you authorize us to charge the applicable fees to your designated payment method.
Accuracy of Information: You must provide current, complete, and accurate billing information.

6.2. Subscription Cycles and Auto-Renewal

Billing Period: Paid listings are billed on a recurring basis (monthly or annually) depending on the plan selected at the time of purchase.
Automatic Renewal: To ensure uninterrupted visibility, subscriptions automatically renew at the end of each billing cycle. Your payment method will be charged automatically unless you cancel your subscription before the renewal date.

6.3. Cancellation Policy

Method of Cancellation: You may cancel your paid listing at any time through your account dashboard or by contacting support at [email protected].
Effect of Cancellation: Upon cancellation, your listing will remain active as a “Premium” listing until the end of your current paid billing period. After that date, your listing will either be downgraded to a “Free” tier or removed, depending on current site policy.

6.4. No-Refund Policy

General Rule: All fees paid for listings are non-refundable. Since the value of the listing (increased search visibility and SEO benefits) is delivered immediately upon activation, we do not offer pro-rated refunds for unused time within a billing cycle.
Exceptions: Refunds may be issued at our sole discretion in cases of documented technical errors or billing mistakes on our part.

6.5. Listing Approval and Removal

Right to Refuse: We reserve the right to reject any listing that does not meet our quality standards or violates our User Roles and Responsibilities.
Violation of Terms: If a paid listing is removed due to a violation of these Terms (e.g., fraud, harassment, or illegal activity), no refund will be provided for the remaining term of the subscription.

7. Limitation of Liability and Disclaimers

7.1. “As-Is” and “As-Available” Service

Pet Pro Search provides this platform on an “as-is” and “as-available” basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the site, the accuracy of the listings, or the quality of the services provided by third parties.

7.2. No Endorsement or Vetting

User Responsibility: While we provide a directory, Pet Pro Search does not employ, recommend, or endorse any specific pet professional or vendor. We do not conduct criminal background checks or verify the specific professional insurance of those listed.
Independent Selection: The choice to hire a professional or purchase from a vendor is solely the responsibility of the user. We are not a party to any agreements made between users and professionals.

7.3. Exclusion of Damages

To the maximum extent permitted by law, Pet Pro Search, its owners, and employees shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

Physical Harm: Injury to persons or pets resulting from services found through our directory.
Financial Loss: Loss of profits, data, or business opportunities for professionals and vendors.
Site Downtime: Any interruptions in service or loss of access to your account or listing.

7.4. Maximum Liability Cap

In the event that Pet Pro Search is found liable for any reason, you agree that our total liability to you for all claims (whether in contract, tort, or otherwise) shall not exceed the total amount of fees you paid to us during the six (6) months prior to the event giving rise to the claim, or $100 USD, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pet Pro Search and its officers from and against any and all claims, damages, obligations, losses, or expenses (including attorney’s fees) arising from:

Your use of the site.
Your violation of these Terms.
Any dispute between you and another user (e.g., a dispute between a pet owner and a dog trainer).
Any content you post to the site (e.g., photos or reviews).

9. Intellectual Property Rights

9.1. Our Intellectual Property

All content, features, and functionality on Pet Pro Search—including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the “look and feel” of the site—are the exclusive property of Pet Pro Search or its licensors. These assets are protected by copyright, trademark, and other intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the site for its intended purposes.
Prohibitions: You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

9.2. User-Generated Content

You retain ownership of the content you upload to Pet Pro Search (e.g., your business bio, photos, or reviews). However, by posting content on the platform, you grant us a specific right to use it:

License Grant: You grant Pet Pro Search a worldwide, royalty-free, perpetual, and non-exclusive license to use, reproduce, modify, adapt, publish, and display your content for the purpose of operating, promoting, and improving our directory.
Visibility: You understand that your listings and reviews are public-facing and can be viewed by anyone on the internet.
Responsibility: You represent and warrant that you own or have the necessary rights to the content you post and that it does not infringe upon the intellectual property rights of any third party (e.g., using a professional photographer’s photo without permission).

9.3. Trademark Usage

The name “Pet Pro Search” and our official logos are trademarks of our company.

Affiliates: Registered affiliates are granted a limited license to use our approved marketing assets (banners, logos) solely for the purpose of promoting the site under the Affiliate Program.
Unauthorized Use: Use of our trademarks to imply an official partnership, endorsement, or “certification” by Pet Pro Search without express written consent is strictly prohibited.

9.4. Copyright Infringement (DMCA)

We respect the intellectual property of others. If you believe that any content on our site infringes upon your copyright, please notify us at [email protected] with the following information:

The URL of the allegedly infringing material.

10. Use of Feedback

If you provide us with any suggestions, ideas, or feedback regarding the site, you agree that we may use such feedback for any purpose without compensation or obligation to you.

11. Dispute Resolution and Governing Law

11.1. Governing Law

These Terms and any dispute arising out of your use of Pet Pro Search shall be governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law principles.

11.2. Informal Resolution

Before filing a formal legal claim, you agree to try to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the matter via email or phone within 30 days of receipt.

11.3. Binding Arbitration

If the dispute is not resolved through informal negotiation, all claims shall be settled by binding arbitration administered by The Forum under its Commercial Arbitration Rules.

Costs: Each party shall bear their own costs and attorney’s fees, unless the arbitrator determines the claim was frivolous.
Location: The arbitration shall take place in Bettendorf, Scott County, IA, unless both parties agree otherwise.

11.4. Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the full extent permitted by law:

No arbitration shall be joined with any other.
There is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures.
There is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

11.5. Time Limit on Claims

You agree that any cause of action arising out of or related to the use of Pet Pro Search must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

12. General Provisions

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
Entire Agreement: These Terms (along with our Privacy Policy) constitute the entire agreement between you and Pet Pro Search regarding the site.
No Waiver: Our failure to enforce any part of these Terms shall not be considered a waiver of our right to enforce them later.
